§ 1 Service description
Only companies may offer and purchase goods from the field of electronics (such as components, cables, devices, etc.) in sales offers via the wwoc shop, provided that their offer, purchase or publication does not violate statutory provisions or these GTC. wwoc itself does not offer any items and does not become a contractual partner of the contracts concluded exclusively between the sellers and buyers, hereinafter referred to as "users", of wwoc. Wwoc acts merely as an intermediary.
wwoc has the right to technically process offers and other content from sellers in such a way that they can also be displayed on mobile devices. Offers and other content may be translated for this purpose. The seller can exclude international buyers from purchasing their items by explicitly excluding international shipping locations or by specifying a corresponding group of buyers in the item text.
Offers published via wwoc and other content from sellers do not represent the opinion of wwoc and are not checked by wwoc for their legality, accuracy and completeness. This also applies in particular to the legality of the photos provided of the items on offer.
Wwoc reserves the right to change the site at any time, provided this is reasonable for the users of this site and no costs are incurred as a result.
Users of wwoc are only entitled to use the site within the scope of current technology. wwoc will temporarily restrict its services if this is necessary due to capacity limits or maintenance work. As far as possible, all users will be informed of this by email.
§ 2 Registration and wwoc account
The use of wwoc as a seller requires registration as a seller. Registration takes place by opening a wwoc account, agreeing to these wwoc GTC and acknowledging the wwoc data protection declaration. Upon registration, a contract for the use of wwoc services is concluded between wwoc and the seller. There is no entitlement to the conclusion of a contract of use.
Only corporate customers are permitted to register, stating their VAT number.
The data requested by wwoc during registration must be complete and correct. No P.O. Box may be given as the address.
If the data provided changes after registration, the user shall be obliged to update the details in his wwoc account immediately.
If wwoc receives notification or otherwise has reason to believe that the information or documents provided by the user are wholly or partially incorrect, incomplete or not up to date, wwoc shall be entitled to request the user to remedy the situation without delay. If the user fails to correct or complete the information or documents within the set period, wwoc shall be entitled to suspend the provision of its services and to block the user until the user has fully complied with the request. 6. Users must keep their password secret and carefully secure access to their wwoc account. Users are obliged to inform wwoc immediately if there are indications that a wwoc account has been misused by a third party.
A wwoc account is not transferable.
§ 3 Use of wwoc
It is the user's responsibility to ensure that his offers and content, in particular images and other information, are lawful and do not violate statutory provisions, the rights of third parties or the wwoc T&Cs. The user's other usage behaviour must also not violate legal regulations, the rights of third parties or the wwoc T&Cs. Among other things, it is prohibited to offer articles on wwoc whose offer, sale or purchase violates legal regulations, the wwoc T&Cs, the rights of third parties or common decency
Sellers are not permitted to demand fees or commissions from buyers in addition to the purchase price.
Users may not use addresses, e-mail addresses and other contact data provided by wwoc for any purpose other than contractual and pre-contractual communication. In particular, it is prohibited to resell this data or to use it for sending advertising unless the respective user has expressly agreed to this in advance in accordance with the applicable statutory provisions or has not objected to it.
§ 4 Fees
wwoc shall charge the seller fees for offering items. If an item is sold, the seller must pay a sales commission to wwoc. The amount of the individual fees and the sales commission can be found on the "Dealer" page.
The individual fees and the sales commission are due for payment immediately and can be paid using the payment methods accepted by wwoc
wwoc may change the fees and sales commission at any time. Users will be notified of price changes in good time before they come into effect.
§ 5 Indemnification
The user shall indemnify wwoc against all claims asserted by other users or other third parties against wwoc due to infringement of their rights by offers and other content posted by the user via the wwoc services or due to the user's other use of the wwoc services.
§ 6 Final provisions
Should individual provisions of these GTC be or become invalid or ineffective in whole or in part, this shall not affect the validity of the remaining provisions. Any provisions of these GTC that are not included or are invalid shall be replaced by statutory law. If such statutory law is not available in the respective case (loophole) or would lead to an unacceptable result, the parties shall enter into negotiations to replace the non-included or invalid provision with a valid provision that comes as close as possible to it in economic terms.
All declarations made within the scope of the licence agreement concluded with wwoc must be made in writing or text form (e.g. by e-mail).
The licence agreement including these GTC shall be governed by German law. The application of the UN Convention on Contracts for the International Sale of Goods is excluded. For consumers domiciled in the EU, the mandatory provisions of the consumer protection law of the member state in which the consumer is domiciled shall also apply if these are more favourable to the consumer than the provisions of German law.
